Proclamation

Proclamation (constitutional) The following proclamations, issued from time to time in between August 1975 and December 1978, made a deep imprint on the nature of the constitution of Bangladesh.

i. Proclamation of 20 August 1975 was made by President Khondakar Mostaq Ahmad on 20 August 1975 in order to amend Article 148 of the Constitution and to omit Part VA of the Constitution which provided the legal basis for one-party system of Bangabandhu Sheikh Mujibur Rahman.

ii. Proclamation of 8 November 1975 was issued by President Abu Sadat Mohammad Sayem with a view to declaring himself the Chief Martial Law Administrator, making the three service chiefs Deputy Chief Martial Law Administrators, dissolving the Jatiya Sangsad and suspending Article 48 of the Constitution.

iii. Second Proclamation (Third Amendment) Order 1975 This proclamation order No III of 1975, issued on 31 December 1975, amended the Articles 66 and 122 of the Constitution. By this proclamation the entry 'The Bangladesh Collaborator (Special Tribunals) Order 1972 (President's Order No. 8 of 1972) was omitted (GOB, 31 December 1975).

iv. The Second Proclamation (Fourth Amendment) Order 1976 The second proclamation order No. 1 of 1976 was issued on 22 January 1976 for amending Article 6 of the Constitution (GOB, 22 January 1976).

v. The Second Proclamation (Sixth Amendment) Order 1976 The second proclamation order No. III of 1976 issued on 4 May omitted the provision to Article 38 (GOB, 1976).

vi. The Second Proclamation (Seventh Amendment) Order 1976 It was made on 28 May 1976 for reconstitution of Article 44 of the Constitution, substitution of Chapter I in Part VI of the Constitution, amendment of Articles 88, 114, 117, 147 and 152, and amendment of the Third Schedule to the Constitution (GOB, 28 May 1976).

vii. The Proclamation (Amendment) Order 1977 By this proclamation order No. 1 of 1977, issued on 23 April 1977, Article 6 was substituted, Preamble to the Constitution was amended, Articles 8, 9, 10, 25, 42, 47, 93, 105, 107, 118, 129 and 139 of the Constitution were amended, Article 12 was omitted and Fourth Schedule to the Constitution was amended (GOB, 23 April 1977).

viii. The Second Proclamation (Fifteenth Amendment) Order 1978 The Second Proclamation Order 1978 (the proclamation order No. 4 of 1978) was issued on 18 December 1978. Its main features were (a) substitution of Article 58 of the Constitution, (b) amendment of Articles 65, 66, 73A, 80, 92, 116, 142, 145, 147 and 152 of the Constitution, and (c) amendment of the Third Schedule and Fourth Schedule (GOB, 18 December 1978).
