Law of Arbitration

Law of Arbitration an alternative mode of settling dispute other than litigation. Originally, the Arbitration Act of 1899 laid down the provisions regarding settlement of disputes by arbitration. Thereafter, provisions regarding settlement of disputes by arbitration through court, including pending suits, were embodied in the schedule of the Civil Procedure Code 1908. Subsequently, a separate law of arbitration without intervention and with intervention of the court was enacted under provisions of the Arbitration Act of 1940 and Arbitration (Protocol and Convention) Act of 1937. However, to meet the demand of present-day disputes, especially the international commercial disputes between nationals and foreigners, the Arbitration Act, 1999 was passed in the Jatiya Sangsad.
